Terms of service
These terms are the agreement between you and MAPLESPACE INC. ("Maplespace", "we"), which makes Gapboard, for using it on the web and in the iPhone app. They are written to be read. By making an account or using Gapboard, you agree to them.
Your account
- You need to be at least 13 to use Gapboard, and old enough where you live to agree to these terms (or have a parent's or guardian's agreement). You need to be an adult to buy Plus.
- An account is for one person. You sign in with a code sent to your email, so keeping that email account secure keeps Gapboard secure; tell us at the address below if you think someone else has got in.
- Your board is yours. You keep every right to what you put in it; Gapboard only stores and processes it to run the app for you, as the privacy policy describes.
Free and Plus
- Free costs nothing and has no time limit. It holds a limited number of projects, habits and quarterly quests at a time, as shown in the app.
- Plus lifts those limits and adds notifications, integrations and the retro looks. It is bought as a monthly or yearly subscription, or once as a lifetime purchase. The price, and any tax, is shown before you pay; payments are handled by Stripe.
- Subscriptions renew automatically at the end of each month or year until you cancel. You can cancel any time from Settings → Account → Manage billing; Plus continues until the end of the period you've already paid for, and isn't charged again.
- Lifetime means Plus for as long as Gapboard is offered, with no further payments.
- Prices can change, but never for a period you've already paid for. If a subscription's renewal price is going up, you'll be told by email at least 30 days before it applies, and you can cancel before then.
- Refunds: if a charge was a mistake or Plus didn't work for you, email within 14 days of the charge and it will be refunded. Beyond that, refunds are at our discretion, except where the law where you live gives you more.
- Moving to Free never deletes anything. Whatever your board already holds stays; the limits only stop new projects, habits or quests being made beyond Free's counts, and Plus-only features switch off.
- Plus isn't sold through Apple's App Store. If you have Plus, it works in the iPhone app too.
Using Gapboard fairly
- Don't use Gapboard to break the law, to store content you have no right to, or to harm anyone.
- Don't try to reach other people's boards, overload or attack the service, or get around the plan limits or payments.
- An account that does any of these can be suspended or closed. Unless it would be unlawful or unsafe, you'll be told why and given a chance to take your data with you first.
Connected services
Connecting a third-party service, such as YouTube or Apple Health, is done with that service's own permission screen and is subject to its own terms. Gapboard reads only what the privacy policy describes, and a connection can be removed any time from the app.
Ending
You can stop using Gapboard whenever you like, and ask for your account to be deleted (see the privacy policy). If Gapboard itself ever shuts down, you'll get at least 60 days' notice to download your board, and anyone with an active paid subscription will be refunded for the time left in it.
No warranty
Gapboard is provided as it is. It's built carefully and backed up daily, but no software is perfect, and it may change, have interruptions, or lose data. Keep your own backups of anything you can't afford to lose — Settings → Account makes one in a click. Nothing in these terms limits rights you have under the law where you live that can't be limited.
Limits on liability
To the fullest extent the law allows, Maplespace is not liable for any loss or damage arising from your use of Gapboard or from being unable to use it — direct, indirect, incidental or consequential — including lost data, lost time and lost profits.
Where the law where you live does not allow liability to be excluded entirely, Maplespace's total liability for anything to do with Gapboard is limited to what you paid for it in the twelve months before the claim. If any part of this section can't be enforced, the rest of it still applies.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute about them or about Gapboard will be heard by the courts of Ontario — except where the law where you live gives you the right to bring a claim in your own courts, or protections these terms can't take away.
Changes to these terms
If these terms change in a way that matters, you'll be told in the app or by email before the change takes effect. Using Gapboard after that means you accept the new terms; if you don't, you can cancel and take your data with you.
